The Family Court is established as a Division of the District Court under the Family Court Act 2014. This Act provides for the constitution, jurisdiction, powers and procedures of the Family Court.

The Family Court has jurisdiction to hear and determine a matter or proceedings under any of the following legislation:

  • Infants Ordinance 1961;
  • Family Safety Act 2013;
  • Maintenance and Affiliation Act 1967;
  • Divorce and Matrimonial Causes Ordinance 1961;
  • Marriage Ordinance 1961;
  • Births, Deaths and Marriages Registration Act 2002;
  • Any other legislation conferring jurisdiction on the Family Court or the District Court.

Such proceedings include but are not limited to applications for adoption, protection orders, separation and divorce orders, maintenance and affiliation orders.  

The Court and lawyers acting on behalf of parties, in any proceedings in the Family Court must, as far as possible, promote conciliation.
